On January 21, 2025, President Donald Trump signed the Executive Order “Ending Illegal Discrimination and Restoring Merit-Based Opportunity,” which revokes Executive Order 11246. The order requires all executive departments and agencies to terminate any discriminatory or illegal preferences, mandates, policies, programs, activities, guidance, regulations, enforcement actions, consent orders, and requirements. For the next 90 days, Federal contractors may follow the regulatory framework effective as of January 20, 2025.

The order also directs the Office of Federal Contract Compliance Programs (OFCCP) to stop promoting diversity, enforcing affirmative action based on gender and race, and encouraging workforce balancing based on race, color, sex, sexual preference, religion, or national origin. However, statutory requirements under Section 503 of the Rehabilitation Act and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) remain in effect.
